Acceptable Use Policy

This Acceptable Use Policy (“Policy”) describes prohibited uses of the Services offered by Nautical Commerce and its affiliates. By using the Services or accessing the Account, you agree to the latest version of this Policy. Violating this Policy or helping others to do so may result in suspension or termination of your use of the Services. In the event of a conflict between this Policy and the Nautical Commerce Terms of Service (https://www.nauticalcommerce.com/legal/terms) or other agreement with us governing your use of our Services (“Agreement”), this Policy shall control, but only to the extent of such conflict. Capitalized terms used but not defined herein shall have the meanings set forth in the Agreement.
No Illegal, Harmful, or Offensive Use or Content
You may not use or encourage others to use the Services or Account for any illegal, harmful, or offensive use, or to transmit, store, display, distribute, or otherwise make available content that is illegal, harmful, or offensive. Prohibited activities include:
- Illegal Activities: Engaging in any illegal activities, including gambling services or child exploitation.
- Harmful or Fraudulent Activities: Engaging in activities that may be harmful to others or our operations, such as fraudulent schemes or deceptive practices.
- Infringing Content: Posting content that infringes on intellectual property rights.
- Offensive Content: Posting defamatory, obscene, abusive, or otherwise objectionable content.
- Harmful Content: Distributing viruses or other harmful software.
- Nautical Commerce is not HIPAA compliant
No Security Violations
You may not use the Services to violate the security or integrity of any network, computer system, or communications system. Prohibited activities include:
- Unauthorized Access: Accessing systems without permission
- Interception: Monitoring data without permission.
- Falsification of Origin: Forging headers or parts of messages.
No Network Abuse
You may not make unauthorized network connections. Prohibited activities include:
- Monitoring or Crawling: Monitoring or crawling systems that disrupt them.
- Denial of Service (DoS): Overloading a target with traffic.
- Intentional Interference: Interfering with the proper functioning of systems.
- Operation of Certain Network Services: Running open proxies, mail relays, or recursive domain name servers.
- Avoiding System Restrictions: Using means to bypass system restrictions.
No E-Mail or Message Abuse
You may not use the Services to distribute unsolicited e-mail or messages. You must comply with the CAN-SPAM Act and similar laws. Prohibited activities include:
- Unsolicited Messages: Sending spam or other unsolicited messages.
- Alteration of Headers: Changing mail headers without permission.
- Collecting Replies: Collecting replies to messages sent from another provider if those messages violate this Policy.
Monitoring and Enforcement
We may investigate violations of this Policy or misuse of the Services or Account. Actions we may take include:
- Investigate Violations: Investigate misuse of the Services or Account.
- Remove or Disable Access: Remove or disable access to content that violates this Policy.
- Report Violations: Report activities that violate laws to law enforcement or appropriate third parties and cooperate with their investigations.
Reporting Violations
If you become aware of any violation of this Policy, immediately notify us and provide assistance to stop or remedy the violation. Report violations to abuse@nauticalcommerce.com.
